TL;DR — Use Questlings fairly and don't abuse it. Your data is yours. Our code and art belong to Pixel Pundit. The app is provided free of charge, as-is. We can suspend accounts that violate these terms. Australian Consumer Law guarantees apply and cannot be excluded. Questions? Email contact@pixelpundit.dev.

1. Acceptance of Terms

By accessing or using Questlings at questlings.dev (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a binding agreement between you and Pixel Pundit ("we", "us", "our"), the operator of Questlings. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Description of Service

Questlings is a gamified task manager. You add tasks; those tasks spawn pixel creatures on an RPG-style board. Procrastinate and the creature levels up. Complete a task and you defeat the creature, earn XP, and collect a trophy.

The Service is currently provided free of charge. We reserve the right to introduce paid features in the future with reasonable notice.

You can use Questlings as a guest (data stored locally in your browser) or as a registered user (data synced to the cloud via Supabase).

To create an account, provide a valid email address and password, or authenticate via Google Sign-In.

Our content: The Questlings name, logo, pixel art, visual design, and code are owned by or licensed to Pixel Pundit and protected by copyright, trademark, and intellectual property laws. You may not copy, distribute, or create derivative works without express written permission.

Your content: You retain full ownership of content you create — task titles, descriptions, and other data you enter. We claim no ownership over your personal content.

By using the Service, you grant Pixel Pundit a limited, non-exclusive, royalty-free licence to store, display, and transmit your content solely for operating the Service. This licence ends when you delete the content or your account.

6. Third-Party Services

Questlings relies on Supabase (authentication and database) and Vercel (hosting and analytics). Your use is also subject to their terms. Social login via Google is subject to Google's terms of service.

You may stop using the Service and delete your account at any time. Account deletion is permanent.

8. Australian Consumer Law

If you are a consumer within the meaning of the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), our goods and services come with guarantees that cannot be excluded under that law. Nothing in these Terms purports to modify or exclude the conditions, warranties, and undertakings implied by the Australian Consumer Law or any other statutory rights you may have.

For major failures with the service, you are entitled to cancel your account and receive compensation for any reasonably foreseeable loss or damage. You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW (AND SUBJECT TO SECTION 8 ABOVE REGARDING AUSTRALIAN CONSUMER LAW GUARANTEES THAT CANNOT BE EXCLUDED), PIXEL PUNDIT'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED AUD $10.

To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill.

We strongly recommend keeping your own backups of important tasks. Questlings is a productivity aid, not an archival system.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Pixel Pundit from claims, damages, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes shall first be attempted to be resolved informally by contacting contact@pixelpundit.dev.

If informal resolution fails, disputes shall be resolved in the courts of competent jurisdiction in Victoria, Australia. You consent to the personal jurisdiction of such courts.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated to registered users via email or in-app notice at least 14 days before taking effect. Continued use constitutes acceptance of the revised Terms.
